The goods covered by these General Terms and Conditions of Sale are offered by:

Pursuant to Legislative Decree no. 70/2003 on electronic commerce.

These General Terms and Conditions govern the sale of products through the e-commerce website maama.it.

The sale is addressed to:

• consumers (B2C), pursuant to Legislative Decree no. 206/2005 (Consumer Code)

• business customers with a VAT number (B2B), upon request for an invoice after purchase

Products are sold exclusively within the Italian territory.

The products offered are packaged food products (bars, spreads, chocolate), including:

• promotional items

• bundled offers

Product information, including ingredients and allergens, is provided in accordance with Regulation (EU) No. 1169/2011.

All prices are expressed in Euro and include VAT, pursuant to applicable tax regulations.

The following may apply:

• automatic discounts on selected products

• promotional discount codes

Shipping costs are indicated separately before order completion, in accordance with Article 49 of the Consumer Code.

Purchases require mandatory user registration.

The order is considered completed upon:

• payment

• receipt of the order confirmation email

Pursuant to Legislative Decree no. 70/2003, the contract is deemed concluded when the seller receives the order from the customer.

The following payment methods are accepted:

• Credit/debit card (via Stripe)

• PayPal

Payments are processed through secure platforms compliant with PSD2 regulations (EU Directive 2015/2366).

Shipments are handled by:

• Arpi Logistics

• DHL

Order processing time:

• orders are processed within 3–5 working days from payment confirmation

Delivery time:

• generally 2–3 working days from shipment

Shipping costs:

• €8 standard shipping

• free for orders over €35

Timeframes are provided in accordance with Article 61 of the Consumer Code.

Orders may be collected at the premises of Meraviglie S.r.l., located at Via del Commercio, 16 – 37066 Sommacampagna (VR), Italy.

Procedure:

• collection must be agreed in advance with Customer Service

• the customer will be notified when the order is ready

Some products, particularly those based on chocolate, are sensitive to high temperatures.

To ensure product quality and food safety:

• during summer months or in the presence of high temperatures, the sale of such products may be temporarily suspended

• products unavailable due to climatic conditions will not be purchasable on the website

These measures are adopted in compliance with food safety obligations under Regulation (EC) No. 178/2002.

Order processing and delivery times are indicative and not binding.

Meraviglie S.r.l. is not responsible for delays caused by:

• couriers

• force majeure events

• unforeseeable circumstances

Any delays do not entitle the customer to compensation, except as provided by applicable law.

The consumer customer has the right to withdraw from the contract within 14 days from delivery of the product, pursuant to Articles 52 et seq. of Legislative Decree no. 206/2005.

The right of withdrawal may be limited in the cases provided for by Article 59 of the Consumer Code, in particular for:

• opened products

• products not returnable for hygiene or health protection reasons

The conditions for exercising this right are set out on the dedicated “Right of Withdrawal” page.

In the event of non-compliant products, the customer is entitled to protection under Articles 128 et seq. of the Consumer Code.

The customer must:

• promptly report the issue

• provide supporting documentation (photos, batch number, description of the issue)

The procedures are set out on the dedicated “Complaints” page.

Products comply with current food regulations.

Any changes in appearance (e.g. chocolate bloom, oil separation in spreads) shall not be considered a lack of conformity if they do not affect product safety or edibility.

Meraviglie S.r.l. shall not be liable for:

• improper use of the products

• storage not in accordance with instructions

• effects resulting from exposure to unsuitable temperatures

For customers with a VAT number:

• invoice requests must be made within the month in which the transaction took place

• otherwise, a commercial receipt will be issued in accordance with applicable tax regulations

These Terms are governed by Italian law.

For consumers:

• the competent court is that of the consumer’s place of residence or domicile
  (pursuant to Article 66-bis of the Consumer Code)

Meraviglie S.r.l. reserves the right to amend these Terms.

The applicable Terms are those in force on the date of the order.
